WANITA DALAM PENDEKATAN FEMINISISME

Abstract

Hukum feminis yang dilandasi sosiologi feminis, filsafat feminis dan sejarah feminis merupakan
perluasan perhatian wanita di kemudian hari. Di akhir abad 20, gerakan feminis banyak
dipandang sebagai sempalan gerakan Critical Legal Studies, yang pada intinya banyak
memberikan kritik terhadap logika hukum yang selama ini digunakan, sifat manipulatif dan
ketergantungan hukum terhadap politik, ekonomi, peranan hukum dalam membentuk pola
hubungan sosial, dan pembentukan hierarki oleh ketentuan hukum secara tidak mendasar.
Teori-teori feminis kerap mengabaikan posisi komtenporer wanita, dengan memusatkan pada
masa-masa lalu yang bersifat historis atau masa-masa depan yang utopis. Fokus pada praxis
seringkali mengenai penciptaan revolusi, reformasi egalitarian, atau utopia-utopia kultural.
Sebagaian besar sosiologi didasarkan pada apa yang dikenal sebagai hubungan individu
dengan dunia sebagaimana adanya dan yang dipertahankan.

Feminist Law which is based on feminist sociology, feminist philosophy and feminist history is
the expansion of female attention at a later date. In the late 20th century, the feminist movement
much viewed as a splinter movement of Critical Legal Studies, which in essence given a critique
of the logic of the law that has been used, the nature of addiction and the law against
manipulative politics, economy, the role of law in shaping patterns of social relations, and the
formation of the hierarchy by law provisions are not fundamental. Feminist theories often ignore
position komtenporer women, with a focus on the past that is historically or the utopian future.
Focusing on praxis is often about the creation of the revolution, egalitarian reform, or utopiautopia
culturally. Most sociology based on what is known as the individual's relationship with the
world as it is and are maintained.
